How Khan saheb misguided viewer --- large scale sex abuse in children is due to corruption in judges, while AK told viewers that it is due to lack of law !!!
====
All over the world, actors love to make money from crisis. For them crisis is an opportunity to make money. Most actors honestly admit it --- that they are reel heroes and not real heroes. But some actors like to act 24 hours a day.
AK has gone two steps ahead. Not only he made crores of rupees by creating sob story on sexual abuse of children, he deliberately misguided viewers to believe that problem is due to lack of laws, where as problem in India is rampant due to corruption in judges from Magistrates to Supreme Court Chief judges. Why did AK protect the judges? I will describe later.
Further, the problem of sexual abuse is most rampant in slum and poor kids. There are organized rackets which kidnap or buy kids and send to farmhouses where foreigners come. But AK knew that showing tragedies of poor kids will not appeal to upper middle class and middle class, who have buying powers and targets of Star Plus channel. So Khan saheb refused to show problems of slum kids and insisted on focusing on sob stories of kids from upper middle class and middle class. So Khan saheb left out the entire problem of child prostitution in India. But then, what else do you expect from a showman who comes Bollywood, which runs on Dawood's money?
Now let me focus on how he misguided viewers. First, there is a law against sex abuse --- children. If it is vaginal, anal or oral sex, punishment is 7 years to 10 years. If it is severe abuse, but no vaginal, oral or anal penetration, then punishment is 3 years. Further, abuse a child several times and abuse many children. So say a abuser has abused 10 kids. Then punishment can be 30 years. But mostly, judges take bribe, and give "concurrent sentencing" i.e. ten 3 year prison sentences will run concurrently, and so instead of 30 years, person comes out in 3 years !!!
How how many times have judges issued 3 year punishment for sexual abuse of children? Rarely. Why? Because of corruption in judges, not because law is lame.
Let me give one more example.
====
Child rights campaigners are up in arms over the leniency displayed by the Indian judicial system towards foreigners who abuse children sexually. The most striking and recent example of this is the ruling of Justice A S Aguiar of the Mumbai High Court setting free two Swiss pedophiles, Wilhelm (61) and Lily Marty (58), on the grounds that "no useful purpose would be served" by keeping them in custody!
The Supreme Court (SC) stayed the judgment, on an appeal filed by the Maharashtra government. However, the SC Bench headed by Chief Justice V N Khare granted bail to the two in an order passed on Monday, April 5, 2004 ......

Some case details are as follows. The Swiss billionaire had rapes three eight year old girls and had also videotaped it himself !! The billionaire's laptop had video showing him raping over 100 girls all from about 7 years to 10 years !! The policemen refused to sell out and so made rock solid case. The learned lower court judge sold out and gave prison sentence of only 7 years, while 15 years could be awarded. The Honorable High Court Justice sold out and set them free !!! And Honorable Supreme Court Chief Justice Khare gave bail !!!! The Swiss billionaire fleed from India. Obviously, the SC-Cj knew that he would flee and despite this SC-Cj gave bail.
One case was reported on Khan Saheb's show where he participant told audience that High Court judge refused to accept oral sex as rape. This was NOT a lacuna of law, it of corruption in judges. No law-draft in world is 100% complete, and judges always have powers to fill the gaps left in text of the law. And the participant also mentioned that Supeme judges took 11 years to hear the appeal. This is all due to corruption in judges.
Now, I am not opposing the coming law against sexual abuse. But Khan Saheb created a wrong message by emphasis that law, and ignoring away the main problem --- which is corruption in judges.
Why did AK hide corruption in judges factor? Well, AK is a big actor and a big businessman and had many right or wrong trials against him or his companies in courts. That is normal in business, nothing unusual. So he doesnt want to upset the judges who can shaft him. So he hid the major reason why child abuse is rampant in India ---- the corruption in judges.
Also, when it comes evidences, narco-test can be very useful. I oppose taking narco-tests as evidence, but I support use of narco-tests to gather evidence. eg if an offender is subjected to narco test, he may reveal where he has hidden pictures of rape etc. He may even give names of other victims, who can be contacted and more testimonies can be obtained. He may give information on where he is hiding bood stained clothes, which can become evidence. IOW, in such closed door crimes like sex abuse of children, narco test can be useful.
Despite this, Khan Saheb opposes narco-tests on child-rapists, and even those who run child prostitution rackets !! Why? Ask him. Here is a hint I give. Bhai Shiromani Dawoodbhai will lose a lot of business if courts use narco-test on his pawns in India. And Bhai Shiromani Dawoodbhai gives a lot of money to Bollywood ventures. Connect the dots and get the picture.

The solution I propose to child abuse problem is
1. All cases of child abuse should be tried by Jurors and NOT judges. The citizens have no faith in judges. The judges from Magistrates with Supreme Court Chief judge reek with corruption. So Jury System should be used in child abuse cases. JurySys is described in chap-30 ofhttp://rahulmehta.com/301.htm
2. In large number of cases, problem is amplified by poverty. I have proposed MRCM-law-draft in chap-5 of http://rahulmehta.com/301.htm to reduce poverty.
3. Narco-test of habitual and organized offenders in public. Curiously, Khan Saheb opposes narco-test on habitual offenders and those involved in child-prostitution. Ask him why.

Sooner we get above law-drafts in Gazette, better it will be the unfortunate kids.
