This status post describes the proposed law-draft -- proposed Gujarat Hindu Community Trust over Somnath Temple act = GHCTST . It can be passed in Gujarat Assembly, and would later need signature of PM. The proposed act will free Somnath Temple from Govt control.

Gujarat Hindu Community Trust over Somnath Temple
.
section - D : Definitions and acronyms
.
(D.1) This Act will apply on Somnath Temple and its Trust in Gujarat.
.
(D.2) The word may means may or need not, and clearly means 'no binding'.
.
(D.3) The religion of a person will be taken as he had given in any election form or ration card form in past. If he is has not specified his religion ever before in past, then he will be eligible to call himself as Hindu.
.
(D.4) The word 'Hindu' will include Hindi, Sikhs, Buddhists, Jains, but not Muslims or Christians or Parsi or Jews. Any other person who declares himself as non-Hindu will not be called as Hindu.
.
(D.5) STT means Somnath Temple Trust
.
section-1 : Appointing \ Replacing Chairman of Somnath Temple trust
.
(1.1) [ procedure for CM ] CM will appoint one Chairman for STT = Somnath Temple Trust which Hindu voters of Gujarat may replace using procedure mentioned in the clauses below.

Explanation : Today also, Somnath Temple Chairman is appointed by CM, but today there is no law by which Hindu voters can replace him.

(1.2) [ procedure for DC = District Collector ] Any voter above the age of 25 years resident in Gujarat , who wishes to be STT Chairman cab register his name at DC's office. DC will register his name by taking fee equal to MP's election deposit.
.
(1.3) [ procedure for Talati = Patwari = Village Office , or his clerk]
.
(1.3.1) If a citizen comes in person to Talati's office, pays Rs 3 fee , and approves at most five persons for the Chairman position, then the Talati would enter his approvals in the computer and would give him a receipt with his voter-id#, date/time and the persons he approved. The fee shall be Rs 1 for those with BPL card.
.
(1.3.2) If a the citizen comes to cancel his Approvals, the Talati will cancel one of more of his approvals without any fee.
.
(1.3.3) DC may create a system of sending SMS feedback to the voter.
.
(1.3.4) DC may create a system of taking finger-print and picture of the voter and putting it on the receipt.
.
(1.3.5) CM may add means to enable citizens to register approvals via SMS. CM may request PM to create a system where by citizens can register approvals via ATM.
.
(1.4) [ procedure for Talati ] The Talati will put the preferences of the citizen on CM's website with citizen's voter-ID number and his preferences.
.
(1.5) [ procedure for CM ] If any Chairman candidate has approval of over 2 crore Hindu voters, and it is also 10 lakh higher than approval count of existing Chairman, then CM may appoint him as new Chairman, and expel the existing Chairman. For this post, the approvals of non-Hindu voters will not be considered.

Explanation : Gujarat has 4 crore voters. Of which, 3 crore 60 lakh are Hindu. Threshold for change is 55% i.e. about 2 crore , and also 10 lakh higher. The CM will update the threshhold using GN every 5 years as voter population changes.
.
(1.6) [ proedure for CM ] As long as Chairman has approval count of over 1 crore and 35 lakh voters, CM need not replace Chairman. If the approval falls below that, then the CM may replace the Chairman with any Chairman of his choice.

section-2 : Jury Trial over Staff
.
(2.1) [ procedure for the Chairman or Officer he designates ] The Chairman , or the Officer he designates, will select 51 Hindu voters from voter list of Gujarat , between age of 25 years and 55 years. Chairman will request them to work as Grand Jurors in Somnath Temple for a salary of Rs 5000 per month plus cost of travel for 2 days a week --- Saturday and Sunday, for 3 months. If some voters selected decline, then Chairman may select more so that count is 51. If Grand Jury is incomplete, then Chairman will function with incomplete Grand Jury.

(2.2) [ procedure for All voters of India , Grand Jurors ] If any voter of India, across any religion, has complaint against a staff of Somnath Temple, then he may present his complaint before Grand Jurors. At least one Grand Juror must agree for hearing. The hearing will be for at least 20 minutes. After that, Grand Jurors will vote if complainer should continue. The complainer can continue till majority Grand Jurors agree. Also, the complainer will always have option of filing complain in applicable court of law.

(2.2) [ procedure Grand Jurors, Chairman ] If over 26 Grand Jurors agree for Jury Trial, then the Chairman will call a Jury to hear the complainer's case.

(2.3) [ procedure for Chairman or officer he appoints ] The Chairman or clerk he appoints for the trial will randomly select 200 Hindu voters between age of 25 years and 55 years and send them summons to appear at the Somnath Temple for trial. If the voters decline, then clerk will select more voters till at least 100 voters agree to come. The voters who are coming will be referred as Jurors. The Jurors will get salary of Rs 200 per day plus travel expenses.

(2.4) [ procedure for Jurors ] The Jurors will hear the complainer and the accused for 1 hour each alternatively for at least 2 days. When over 51% of all Jurors declare that they have heard enough, both the complainer and accused will speak exactly for 1 more day. After one day, if majority Jurors say that hearing should go on, the hearing will go on for at least 1 day or number of days decided by Jurors. Or, the hearing will end. The last 1 hout must be given to accused.

(2.5) [ procedure for Chairman , Jurors ]
.
(2.5.1) If over 67% of Jurors declare that the exployee should be expelled , then the Chairman may expel the employee. Otherwise, the Chairman need not expel the employee.
.
(2.5.2) If over 50% of Jurors declare that employee must be fined , then the Chairman will deduct 25% of salary till fine is paid. Each Juror will declare the fine he deems right, and the Chairman will take median (not mean) fine. And maximum fine will be 12 monthly salaries.

Section-TCP : Tcp.State clauses
.
(Tcp.1) [ procedure for Collector ] If any citizen wants a change in this law, he may submit an affidavit at DC 's office and DC or his clerk will post the affidavit on the website of Prime Minister for a fee of Rs 20/- per page.

(Tcp.2) [ procedure for Talati or Patwari ] If any citizens want to register his opposition to this law or any section or wants to register YES-NO to any affidavit submitted in above clause, and he comes to Talati 's office with voter-ID and pays Rs 3 fee, Talati will enter YES/NO and give him a receipt. The YES-NO will be posted on CM's website.
