Constitution of the Party
Article I:       Name of the Party
                        The name of the party shall be Right to Recall Party.
Article II:      Objectives of the Party
To establish the real Democracy means system should be for the people, by the people & of the people. Self rule by the people of the country by using the rules TCP (Transparent Complain/Suggestion System), Jury Trial, Right to Recall etc.
Right to Recall Party shall bear true faith and allegiance to the Constitution of India as by law established and to the principles of socialism, secularism and democracy and would uphold the sovereignty, unity and integrity of India.
To make our country’s defence stronger in order to provide security to all citizen of India.
To work for removing the country problems like poverty, unemployment, illiterate, corruption, terrorism etc.
Article III:     Membership of the Party
  1. Eligibility of Member
Every citizen of India of the age of 18 years or more, residing anywhere in the world who support party policies & objective shall be eligible to become a member of the party by paying Rs. 10 per year or Rs.100/- lifetime membership fee provided that he or she:
    1.1 Is not a member of any other political party registered with the Election Commission of Inda
      1.2 Has not been convicted of any offence involving moral turpitude.

        2. Categories of Membership
          2.1 Active Member
            Actively participated in various programs of the party to accomplish the objectives of the party.
              2.2 Ordinary Member
                Who support the party’s policies & objectives.


                3. Management of Membership
                  3.1 Membership forms of the Party shall be made freely available on the party website on the internet or from each concerned Executive Committee office at different level. Membership forms shall also be issued in the form of books containing 50 forms each, to be issued to each member who desires to enrol other members.
                    3.2 Each member will be allotted a unique serial number containing Parliamentary constituency number, followed by the Legislative Assembly number and  other number as approved by the National Executive Committee.
                      3.3 Membership register shall be prepared containing member detail and shall be updated as on the 1st January of a given year by the concerned Secretary.

                          4. Cessation of Member
                            All members shall cease to be a member of the Party in the event of:
                              4.1 Death
                                4.2 Resignation
                                  4.3 Expulsion/Removal
                                    4.4 If he/she join any other political party
                                      4.5 On being convicted by the court of law for a crime involving moral turpitude.

                                           5. Suspension of Member
                                            The National Executive or the State Executive may suspend any member from membership of the Party pending disciplinary proceeding.

                                            Article IV:    Organisational Structure
                                            1. Village Executive Committee (Gram Shabha)
                                            2. Tensile/Town/District City Executive Committee
                                                3. District Executive Committee
                                                    4. State/Union Territory Level Executive Committee
                                                        5. National Executive Committee

                                                            1. Village Executive Committee/Gram Shabha :
                                                              Village Executive Committee shall comprise of seven members who are appointed by all the members of the party in the village by mutual consensus or by voting. They all seven member shall be responsible for all the activities of the party in the village to accomplish the objectives of the party. They all are recallable by the members of the village.
                                                              • Powers, Duties and functions of Village Executive Committee:
                                                                1.1 Elect the President of the Village Executive Committee who shall plan, manage, supervise, delegate and responsible for all the activities of the village.
                                                                  1.2 Appoint the Secretary who shall keep and maintain the membership record, manage the meeting and maintain the minutes of the meeting.
                                                                    1.3 Appoint the Treasurer who keep and maintain the accounts and financial records.
                                                                      1.4 Appoint a person for the District Executive Committee who shall represent the village.
                                                                        1.5 Meet at least twice every year.

                                                                            2. Tensile/Town/District City Executive Committee :
                                                                              It shall comprise of all members each one is appointed by each Locality members of the party in the Tensile/Town/District by mutual consensus or by voting. They all Concerned Executive member shall be responsible for all the activities of the party in their concerned area to accomplish the objectives of the party. They all are recallable by their concerned area members.
                                                                              • Powers, Duties and functions of the Tensile/Town/District City Executive Committee :
                                                                                2.1 Elect the president of the committee who shall plan, manage, supervise, delegate and responsible of all the activities.
                                                                                  2.2 Appoint the Secretary who shall keep and maintain the membership record, manage the meeting and maintain the minutes of the meeting.
                                                                                    2.3 Appoint the Treasurer who shall keep and maintain the accounts and financial records.
                                                                                      2.4 Appoint a person for the District Executive Committee who shall represent the Tensile/Town/District City.
                                                                                        2.5 Meet at least twice every year.

                                                                                              3. District Executive Committee :
                                                                                                District Executive Committee shall comprise of all the person each is appointed by all the executive committee in the district.
                                                                                                • Powers, Duties and functions of the District Executive Committee :
                                                                                                • 3.1 Elect the president of the committee who shall plan, manage, supervise, delegate and responsible of all the activities to accomplish the objective of the party. 3.2 Appoint the Treasurer who shall keep and maintain the accounts and financial records.3.3 Appoint a Secretary who shall notice for the meeting, maintain and keep the membership records and minutes of the meeting.3.4 Recall the President, Treasurer and Secretary or any other person in case of irregularity and indiscipline.3.5 Provide the suggestion to the upper level to fulfil the objectives of the party.3.6 Meet at least twice every year.
                                                                                                  4. State/Union Territory level Executive Committee :
                                                                                                    State Level Executive Committee shall comprise of members appointed one member by each District Level Executive Committee in the state. Each member appointed by each District Level Executive Committee shall be recallable by their respective District Level Executive Committee in case of any irregularity and indiscipline.
                                                                                                    • Powers, Duties and functions of the State Level Executive Committee :
                                                                                                      4.1 Elect the president of the committee who shall plan, manage, supervise, delegate and responsible of all the activities to accomplish the objective of the party.
                                                                                                        4.2 Appoint the Treasurer who shall keep and maintain the accounts and financial records.
                                                                                                          4.3 Appoint the Secretary who shall notice for the meeting, maintain and keep the minutes of the meeting and membership records.
                                                                                                            4.4 Recall the President, Treasurer and membership record holders or any other person in case of irregularity and indiscipline.
                                                                                                              4.5 Provide the suggestion to the upper level to fulfil the objectives of the party.
                                                                                                                4.6 Meet at least twice every year.
                                                                                                                  4.7 Form as many teams and assign the work as required to carry out the objectives of the Party.

                                                                                                                        5. National Executive Committee:
                                                                                                                          National Executive Committee shall be the highest policy making body of the party. It shall comprise of the convenors one is appointed by each States/Union Territory Executive Committee and others 1/3rd members are nominated by the association of person of recallist who come together to form the party.
                                                                                                                          • Powers, Duties and functions of the National Executive Committee :
                                                                                                                            5.1 Elect the president of the committee who shall plan, manage, supervise, delegate and responsible of all the activities to accomplish the objective of the party.
                                                                                                                              5.2 Appoint the Secretary who shall notice for the meeting, maintain and keep the minutes of the meeting and membership records.
                                                                                                                                5.3 Appoint the Treasurer who shall keep and maintain the accounts and financial records.
                                                                                                                                  5.4 Recall the President, Treasurer and membership record holders or any other person in case of irregularity and indiscipline.
                                                                                                                                    5.5 Meet once in every three months.
                                                                                                                                      5.6 Have the power to amend the constitution of the party but have to pass a resolution in this regard in the next General Meeting of the Party.
                                                                                                                                        5.7 Form as many teams and assign the work as required to carry out the objectives of the Party.


                                                                                                                                          Article V:      Office-Bearers of the Party
                                                                                                                                          1. Convenor
                                                                                                                                          2. Secretary
                                                                                                                                          3. Treasurer
                                                                                                                                          4. President

                                                                                                                                          1. Convenor:
                                                                                                                                          The convenor at the concerned level shall:
                                                                                                                                            1.1 Facilitate and organize the meeting at concerned level.
                                                                                                                                              1.2 Implement and execute the decisions of the Party and carry out all such work as assigned by the concerned Executive Committee.
                                                                                                                                                2. Secretary:
                                                                                                                                                The secretary at respective level shall be responsible:
                                                                                                                                                  2.1 For managing day to day affair of the party at the concerned level.
                                                                                                                                                    2.2 For maintaining records and keeping the minutes of the meeting at the concerned level.
                                                                                                                                                      2.3 Carrying out all such work as given to him/her by the Party from time to time.
                                                                                                                                                        2.4 Secretary at National Level shall represent Party for all legal purposes.

                                                                                                                                                          3. Treasurer:
                                                                                                                                                          Treasurer shall be responsible:
                                                                                                                                                            3.1 For maintaining and keeping accounts at the concerned level.
                                                                                                                                                              3.2 Follow all guidelines and instructions issued from time to time with respect to maintaining accounts by National Treasurer to others lower Level Treasurer.
                                                                                                                                                                National Treasurer shall ensure that:
                                                                                                                                                                  3.3 The accounts of the Party are properly maintained and are audited by the auditor.
                                                                                                                                                                    3.4 All statutory compliance regarding accounts an Party funds are duly made
                                                                                                                                                                      3.5 Audited annual accounts of the Party are submitted to the Election Commission of India within six months from the end of the financial year.

                                                                                                                                                                        4. President:
                                                                                                                                                                        The President of the Party shall ensure that all office-bears are working to accomplish the objectives of the Party and compliance to all rules and regulations applicable.
                                                                                                                                                                        Functions/Duties/Power:
                                                                                                                                                                          4.1 Provide guidelines and instructions to any office-bearer to accomplish the objective of the Party.
                                                                                                                                                                            4.2 Call the meeting of office-bearer.
                                                                                                                                                                              4.3 Assign a work to any person to accomplish the objective of the party.

                                                                                                                                                                                Term of Office Bearer:
                                                                                                                                                                                No member shall hold the same post as an office bearer for more than five years and shall retire after one term. No member shall hold more than one post at a time.

                                                                                                                                                                                Article VI:    Rules of Dispute Resolution & Discipline
                                                                                                                                                                                • Code of Conduct:
                                                                                                                                                                                Every member of the Party shall abide by the following code of conduct:
                                                                                                                                                                                1. A member shall not engage himself/herself in any immoral or illegal activity as would tarnish the image of the Party
                                                                                                                                                                                2. A member shall not undertake any activities which is in violation of or is contrary to the official policy of the party.
                                                                                                                                                                                3. A member shall not violate any rule made by the Party or disobey any direction given by it.
                                                                                                                                                                                4. Mere expression of difference of opinion by the office bearer will not consider as violation of code of conduct unless it violates the objectives of the Party.
                                                                                                                                                                                5. Office bearer must also:
                                                                                                                                                                                5.1  Not involve him/her in any corrupt practice.
                                                                                                                                                                                5.2  Not have any pending criminal case of a crime involving moral turpitude or should not have been conducted of any such crime in the past.
                                                                                                                                                                                5.3  Not be part of any organization which spreads disharmony on the basis of religion or caste or promotes untouchably.
                                                                                                                                                                                5.4  Not engage in exploiting or ill-treating woman.
                                                                                                                                                                                5.5  Not indulge in drug addiction or drunken behaviour.
                                                                                                                                                                                5.6  Make an annual declaration of his/her income and that of his family honestly and correctly to the Party.

                                                                                                                                                                                • Authority for Disciplinary Action
                                                                                                                                                                                The Executive Committee shall take necessary action for complain of violation of code of conduct against office bearers at the respective level.
                                                                                                                                                                                The disciplinary action may result in penalties ranging from warning, suspension or expulsion from the party.
                                                                                                                                                                                No disciplinary action shall be taken against a member without giving an opportunity to that member to explain and answer the charges against him/her.

                                                                                                                                                                                Article VII: Basics of Rules of Conduct of Business
                                                                                                                                                                                1. Meeting
                                                                                                                                                                                The Secretary shall be responsible to hold the General Meeting of the members of respective Executive Committee. The meeting shall be held at least once in a year. If required, a meeting of committee may be requisitioned by 1/3rd of the members of concerned executive committee.

                                                                                                                                                                                  2. Quorum
                                                                                                                                                                                    Quorum of all the meetings shall be one-strength of the concerned body. If quorum is not complete at the appointed time, those assembled will wait for maximum period of 30 minutes. If quorum is still not available, the meeting shall be adjourned. A new meeting will then be convened and there shall be no need of quorum for a meeting that was adjourned due to want of quorum.
                                                                                                                                                                                    There will be no requirement of a quorum in case of Emergency or Extraordinary meetings. However resolutions passed in such meetings shall be required to be ratified in the next ordinary meeting of the concerned body.

                                                                                                                                                                                      3. Notice
                                                                                                                                                                                        The notice period of ordinary meeting of the body shall be 7 days. The emergency meeting of the concerned body may be convened by the concerned convenor by giving such notice as deemed fit. The above time period would not be applicable for such meetings. The member may attend the meeting either in person or via video/teleconference. 

                                                                                                                                                                                          4. Decision Making
                                                                                                                                                                                            All the decision at all the level in any meeting shall be taken by consensus failing which by majority vote. However, approval of 2/3rd of members, present and voting will be required for a resolution for amendment of the party constitution and/or decision to merge, split or dissolve.

                                                                                                                                                                                              5. Minutes
                                                                                                                                                                                                The party shall maintain and keep the minutes of all the meeting at the concerned level.

                                                                                                                                                                                                Article VIII: Party Funds and Accounts
                                                                                                                                                                                                1. Collection of Funds
                                                                                                                                                                                                1.1  Funds shall be collected by means of membership fees and voluntary donations.
                                                                                                                                                                                                1.2  Maximum voluntary donation per individual shall be accepted Rs.20000.
                                                                                                                                                                                                1.3  No donation shall be accepted other than individual.
                                                                                                                                                                                                1.4  The Treasurer of concerned level shall receive the donation and disburse for accomplish the objectives of the party and maintain the proper records.

                                                                                                                                                                                                  2. Donation and Membership Receipts
                                                                                                                                                                                                    2.1  Fund collection receipt will be printed at the concerned level.
                                                                                                                                                                                                    2.2  Each receipt will be duly numbered and issued in book containing 100 receipts.

                                                                                                                                                                                                      3. Bank Account
                                                                                                                                                                                                        3.1  The party shall open such number of bank accounts and at such places as necessary.
                                                                                                                                                                                                        3.2  There shall be two authorised signatories for each bank account namely the Treasurer and the President of the concerned level. The account shall be operated by the Treasurer who shall be the authorised signatory.
                                                                                                                                                                                                        3.3  All the receipt shall be deposited in the bank account and all the expense shall be routed through such bank account.

                                                                                                                                                                                                          4. Utilisation of Fund
                                                                                                                                                                                                            4.1  Party fund shall be utilized for the political activities.
                                                                                                                                                                                                            4.2  The funds received by the party shall be utilised for meeting the objectives of the party through advertisements in newspapers, radio, television, through pamphlets, wall/board advertisements.
                                                                                                                                                                                                            4.3  The funds shall be utilised by the Executive Committee or through the regulation made by it governing the utilisation of fund.

                                                                                                                                                                                                              5. Accounts
                                                                                                                                                                                                                5.1  The accounts shall be made on accrual basis. The details of all the donations and expenses will be made transparent.
                                                                                                                                                                                                                5.2  Accounts are annually audited by the Auditor on the panel of CAG.
                                                                                                                                                                                                                5.3  Audited annual accounts submit to the ECI within 6months of the end of financial year.

                                                                                                                                                                                                                Article IX: Amendment of Constitution
                                                                                                                                                                                                                This constitution can be amended by the National Executive Committee provided that the amendment has the approval of 2/3rd of its members present and voting after due notice to all the members. For this purpose a meeting of the National Executive Committee shall be convened within 30 days of a resolution for amendment bearing the signatures of at least 10% members of the National Executive Committee being received.

                                                                                                                                                                                                                Article X: Merger, Split and Dissolution
                                                                                                                                                                                                                The party shall follow the principle of Merger and Split as provided in the Schedule X of the Constitution of India.
                                                                                                                                                                                                                In the unlikely event of Dissolution, a meeting of National Executive Committee of the Party will be convened for this purpose.

                                                                                                                                                                                                                Article XI: Interpretation of the Constitution
                                                                                                                                                                                                                The National Executive Committee alone shall have the power and authority to interpret this Constitution and the regulations frame there under. The decision of the National Executive Committee in respect of the above shall be final and binding unless it is overturned by the National Council in its next meeting.
