We at Right to Recall group have been demanding since 2008 that a candidate in SC / ST / OBC should get seat in his quota and not in General quota. Today, Gujarat High Court has given judgement along same line
.
We dont take ANY credit for court case --- someone else filed the case did did the bulk work. We only circulated the proposal since 2008. More and more people came to know. I am not sure if litigant came to know via our efforts --- because people have been working on THIS demand since 1990s. In fact, Tamil Nadu had implemented this rule in 1990 !!

section-36.3 " Stand on issued linked with reservation" , line item-5 says

5. The person in reservation caste will get seat in reservation quota first, and will be considered in general list only after his reservation quota is full..

So when his quota is full, the next person's score will be far far less than closing rank of general, and so he wont get general seat anyway.

If activists had paid attention to this demand, and instead of SoMoKe-andhbhakti, had taken up this demand, then Govt would have issued GN to implement this demand anyway. But instead, activists decided to confine to SoMoKe-andhbhakti. And so this demand didnt go far.

Over 8 people died , some Rs 200 crore of property got gutted, and population of 6 crore ended up wasting 3-4 days of productive time. And worse may come. And all this would have been LESS , if activists had paid attention to a simple fact, that "law-drafts are important , not vyakti-puja". .

Anyway, I will request all activist focus on following law-drafts I have proposed to reduce the reservation mess
.
(A.1) I have proposed a law-draft that will reduce reservation from 49% to 5% of may be less , at cost of Rs 1000 per YEAR per Dalit / ST / OBC i.e. about Rs 84000 crores per year, which will increase existing taxes by about 5% . (A.2) Another proposed law-draft will further reduce caste based reservation by eliminated double options i,e. SC , ST and OBC can opt in General as well as their own quota . The draft is athttps://www.facebook.com/mehtarahulc/posts/10152990537221922

(A.3) Another proposed law-draft is --- if % of job holders belonging to a sub-caste in a Govt, including its PSUs , is more than their % population of that sub-caste , then reservation for that sub-caste will be suspended for a few years.
