(A.1) I have proposed a law-draft that will reduce reservation from 49% to 5% of may be less , at cost of Rs 1000 per YEAR per Dalit / ST / OBC i.e. about Rs 84000 crores per year, which will increase existing taxes by about 5% . How many would demand / oppose reservation for job of say sweeper in private companies? Not many. Because they get some Rs 300 a day for work of some Rs 300 a day..

How many would demand / oppose reservation for job of say car mechanics? Not many. Because they get Rs 500 to Rs 1000 a day for work of same amount.

IOW, where earnings are almost same as labor performed , demand for reservation is low and opposition to reservation in such places is also low.

Now why do many want reservation in Govt jobs?
.
The MOST important reason is ---- because Govt jobs fetch huge amount of money for lot less work !! Even when work is high, the money that the govt employees get is far far higher than the work they do. This is in most cases. There may be some exceptions.

So basically, IF CORRUPTION IS REMOVED , THEN DEMAND / OPPOSITION FOR RESERVATION WILL BOTH FALL !!!

But every time reservation issue comes, I notice that those of 10000s of those who are opposing / supporting reservation , less than 2% are interested in forcing MPs to print law-drafts to reduce corruption. They are ONLY interested in forcing MPs to print law-drafts on reservation issue !!!

So as such, both -- those who support reservation and those who oppose it -- are fighting ONLY for "Right to take bribes " !!

Those who want reservation are effectively saying --- "Govt employees make Rs X crore of bribes every year ; I am NOT interested in forcing MPs to print law-drafts to reduce corruption. I want to force MPs to print law-drafts that my community should get n% of that Rs X crore, where n% is my % in total population" !!

And those who oppose reservation say ""Govt employees make Rs X crore of bribes every year ; I am NOT interested in forcing MPs to print law-drafts to reduce corruption. I want to force MPs to print law-drafts that reservation should end and bribes should go to the most meritorious ones !!".

Both statements are ludicrous at best.

Take USa for example. USA has de-facto reservation called as Equal Opportunity Employment. This is nothing but some reservation for African Americans etc. There is not much demand for it, and not much opposition either. Because who-so-ever gets benefit of EOE doesnt earn a jackpot, He has to work hard, and gets paid accordingly.
.
Likewise, consider those who sat that reservation is injustice to merit, Well, pls see closing % in medical colleges for SC, ST, OBC, General and self financed quota , and NRI quota. Many times General closing is 92%, Sc will be just 88% i.e. only a few % less, OBC will be just 2% below General, and NRI would be as low as 70% !! IOW, much more damage is being done by self financed quota !!

And strangely, those who ippose reservation for SC / ST / OBC on basis of merit never demanded expulsion of Ministers / judges who upheld self-financed quota !!!

My point is --- those want to reduce the mess should focus on FORCING MPs to print law-drafts to reduce corruption and reduce management / NRI quota ----- such as RTR , JurySys, narcotest in public in case of high corruption cases etc. When corruption in govt employees reduce, both, demand for reservation will reduce and oppsoition for reservation will reduce.

In any case, to reduce the reservation mess, I have proposed 3 law-drafts mentioned in section-A above.

(D) Why I support caste based reservation
,
Caste based discrimination is real. And it is fact that as of now, much of appointments in administration, appointment in courts,, judgements in courts, allocation of contracts, promoion etc go by nepotism. And in such cases, SC , ST and OBC get pushed back despite merit. And so there is a real case of caste based reservation.

eg consider High Court judiciary. There are some 600 HCjs, How many are SC / ST and OBC? I request the reader to find out this % himself. Why is number so low? The main reason is --- the decision to appoint Magistrate , sessions judges, HCjs , Scjs etc is all discretion of few judges who in 1950s were all upper caste. And so they exclude out lower castes when appointing next batch. And nepotism is rampant in giving judgements as well.

There have been numerous too many cases SC / ST / OBC candidates, who have topped written exam,, literally fial interviews !!! And the main reason isnt lack of merit --- but plain vaninall caste discrimination,

The reason why upper caste Hindus in Congress in late 1940s and early 1950s supported caste based reservation for lower caste was --- they knew that if reservation is not put, then most lower caste would sooner or later fall in the lap of Missionaries. The leaders back then saw no way to reduce nepotism in apex or middle layers. And so they introduced caste based reservation as something that hold SC / ST etc into Hinduism and not walk to Missionaries.

The solution to nepotism problem I propose are -- Jury System, RTR , Multi-elections, removing interviws and recruitments by written exams ONLY. We at Right to Recall Group are working to FORCE existing CMs / PM to print these law-drafts. When these law-drafts get printed, one has to see if nepotism has ended. If nepotism ends, there is a case to remove caste based resevation. Till then, I support caste based reservation.

There are people who have lakhs and crores of rupees of cash income and zero income by cheque. They will all manage to get "Below poverty line card" and manage to qualify for Economic Reservation !!! These people have properties in crores, but keep in the name of relatives or keep in cash / gold form.

The real poor dont reach class-Xth. So the real poor will never get any reservation benefits anyway. So if N seats are reserved for poor, then all N seats will go "rich in reality , poor on paper" type people.

So reservation on economic basis is pointless

(F) About current demand from some Patels for "Reservation for Patels".
.
The demand is non-starter. The reservation is given only when % of community is X5 and their % in govt jobs is below x%. Patels in Gujarat are about 15% to 20% of population. And their % in Govt jobs is well above 20% . So reservation for Patels is non-stater.

The Govt is using lie That reservation cant exceed 49%. Well, Tamil Nadu has been having reservation of 69% since 1980s !!!
.
What SCjs have said is --- Executive can increase reservation in a state above 50% ONLY if 67% of MPs approve. IOW, State Govt can on its own take reservation only to 49%. But if 67% MPs allow , then State Govt can very well take reservation to even 75% or even more !!! (Please google on "Constitution of India , 9th schedule for on this).

Besides, SCjs can be also asked to change judgement and can be expelled / replaced.
.
So it is shameful that Govt of Gujarat uses lies like ":reservation cant go beyond 49%" as if it was some law of Physics.

But central point is --- % of seats obtained by Patels is well above their % population. So ,even if 15% reservation is kept for Patels, it will make ZERO DIFFERENCE !!

(G) Why I oppose demand --- to put Patels in OBC list
.
Some Patel leaders have insisted that Patels should be put in OBC list.

Not all Patels agree with above proposal.
.
One can make case for 15% EXTRA reservation for Patels. Though it wont make any difference as I explained earlier in above section. But demand to put Patels in OBC list will cause bigger backlash from existing OBCs. OBCs in Gujarat are about 40% of population. They get some 27% reservation. In merit list, they are way behind Patels, on an average, in general. If Patels are put in OBC, then patels will manage to secure at least 20% (my estimate) of seats . So existing OBCs w, who are some 40% of population, will get pushed into some mere 5% to 7% seats.

All in all, OBCs dont mind increasing reservation to 65% and giving next 16% to Patels. But giving slice of OBCs's pie to Patels will be seriously non-acceptable to them

(H) Electoral angles to current Rservation strife in Patels
.
From 1977 to 1995 , Congress supported reservation. Whenever there was opposition to reservation, BJP created an image that they are anti-reservation !! BJP-leaders never made any statement against reservation. But they did create an image that the are against reservation !! So many Patels and other Upper Caste Hindus became supporters of BJP with hope that BJP will remove reservation when BJP comes into power. Now bwteen , 1984 to 2005 , BJP used Hinduvaad to get votes from lower caste Hindus. Hinduvaad was used by Ram Janam Bhoomi , Krishna Janam Bhoomi, Kashi Vishvanath, art-370, Unifrm Civil Code, 2002 riots etc. But Hinduvaad started waning by 2005. So BJP was left with no option but to support SC , ST, OBC when it came to jobs,college seats, govt contracts etc.

This has created feeling of "being backstabbed" in Patels. Many Patels feel that BJP leaders have backstabbed them or cheated them.
.
This coupled with unemployment and under-employment, and over expectations about employment , has made many upper caste youth restless. They have been made to believe that reservation will reduce unemployment and under-employment !!

So feeling of being cheated by BJP , unemployment, under-employment etc are reasons why volcanoes has re-erupted.

I have proposed some law-drafts to reduce the reservation mess in section-A

The law-drafts to reduce unemployment are --- (a) wealth tax and removal of GST / VAT / CST / service tax / excise so that land prices fall and more factories start (b) Jury System so that corruption and harassment of Govt officers on factory owners reduce (c) Jury System over labor disputes (d) DDMCRAM -- so that demand increase and so forth, I have explained these proposed law-drtafts in chap-63 of http://rahulmehta.com/301.htm
