Those who believe that NaMo will remove reservation may face a rude shock soon --- "defacto reservation" may increase in judges
.
Let me explain.
.
Till date judges appoint appoint judges. Almost all judges in late 1940s were upper caste and I do NOT blame anyone for that. They appointed only upper caste. And so exceot in two states, TN and kerala, where dalits / obc were politucally vey powerful, and numerous, % of judges in high court that were Sc / ST / OBC remained below 5% to at most 10% sometimes. (In TN it is 50% and in Kerala it is some 35%).
.
But now as per new rules, PM will appoint 3 of his puppets and three judges will be called to form committee of six members called National judicial Appointment Commission. And these 6 members will appoint judges.
.
So now MPs / MLAs / party-workers / voters / paidmediamen etc will exert pressure on PM to appoint judges of their choice. And they may succeed or they may not.
.
So lets see how the tides turn.
.
RIght now, due to paidmedia, PM is immune to pressure of MPs, MLAs , party leaders, party workers and even voters
.
But if paidmedia weakens, then pressure of voters, party workers etc will start mattering. And they will push for PM to appoint judges of their castes. So defacto caste based reservation in judges may happen.
.
All depends on who becomes more influential in times to come.
